Terms of service

These Terms of Service (the "Terms") govern your access to and use of Hey Homework, including the website at heyhomework.com, its localized versions, and any related services (together, the "Service"). The Service is operated by [Company legal name], a [Wyoming] limited liability company ("Hey Homework", "we", "us"). By creating an account, buying a plan, or using the Service in any way, you accept these Terms. If you do not agree, do not use the Service.
Summary in plain words. Hey Homework is a study aid that uses artificial intelligence. It explains problems; it does not promise that any answer is right, and it does not do your schoolwork for you. You must be at least 13. Paid plans renew until you cancel. Disputes go to individual arbitration unless you opt out within 30 days. Where the law where you live gives you rights we cannot limit, those rights still apply.
1. Who can use Hey Homework
You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian has read these Terms and allows you to use the Service, and that parent or guardian agrees to these Terms on your behalf. Paid plans and tokens may only be purchased by someone who is 18 or older, or by a parent or guardian on a minor's behalf. If we learn that a user is under 13, we will close the account and delete its data as described in our Privacy Policy. Where the law of your country sets a higher minimum age for consenting to online services, that age applies.
2. What the Service is, and is not
Hey Homework generates explanations, answers, hints, checks, summaries, spoken conversation and similar output using AI models ("Output"). Output is produced automatically and is not reviewed by a person before you see it. Output can be wrong, incomplete, out of date or inappropriate for your situation. It is not a substitute for a teacher, a textbook, or your own work, and it is not professional, medical, legal or financial advice. You are responsible for checking Output before relying on it, especially for anything that is graded or that matters. We do not promise any particular level of accuracy, availability, speed or results.
3. Accounts
You can use a limited free version without an account. Some features need an account. You must give accurate information, keep your sign-in details private, and tell us at [support@heyhomework.com] if you think someone else is using your account. You are responsible for what happens under your account. We may refuse, suspend or close accounts at our discretion, including for inactivity, abuse, or a breach of these Terms.
4. Free use, plans and tokens
Free use is limited to an allowance of usage tokens per device and per account, per day or per week, which we set and may change, and which may differ between users while we test what works best. Paid plans ("Pro", "Pro+", "Max" or as named on the Service) include a weekly allowance of usage tokens, which cover questions, photos, follow-ups, voice and other AI features according to the model tokens and minutes each request uses; tokens can be bought to use beyond the allowance. Allowances, features, model behavior, prices and plan names are described on the Service at the time of purchase and may change; changes to the price of a subscription you already have take effect only as described in our Subscription and Billing Policy. Allowances that are not used do not roll over. Tokens have no cash value, cannot be transferred, and are used only within the Service. We may apply fair-use limits, rate limits and abuse controls, and may pause an account that automates requests or shares access, to protect the Service and other users. Billing, renewal, cancellation and refunds are governed by our Subscription and Billing Policy and our Refund Policy, which are part of these Terms.
5. Your content
"Your Content" means the photos, text, voice recordings, files, notes and other material you submit. You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, adapt and create derivative works of Your Content as needed to operate, secure, moderate, support, analyze and improve the Service, to provide it to you across devices, and to comply with law. This license lasts as long as needed for those purposes and ends when the content is deleted from our systems, except for copies kept in routine backups or as the law requires. You confirm you have the rights needed to submit Your Content and that it does not break Section 7. We do not use Your Content to train AI models unless you choose a setting that allows it; we may use aggregated or de-identified data that cannot reasonably identify you. Do not submit personal information about other people, or anything you do not have the right to share.
6. Output
Subject to these Terms and to the rights of others, you may use Output for your own personal, non-commercial learning. Because Output is generated by AI, it may be similar or identical to Output produced for other users, and no one has an exclusive claim to it. You must not present Output as human-written where that would be dishonest or against a rule that applies to you. We may keep and review Output and Your Content to detect abuse, enforce these Terms and improve the Service.
7. Acceptable use
You agree not to: use the Service during a test, quiz or exam, or where your school or institution does not allow AI help; submit content that is illegal, hateful, sexual, violent, dangerous, or that harasses or exposes another person; upload other people's personal information or copyrighted material you may not share; try to extract our prompts, instructions or model configuration; probe, scrape, reverse engineer or overload the Service; bypass usage limits, share accounts, or resell access; use the Service to build a competing product; or use the Service in a way that could harm minors. Our Academic Honesty and Acceptable Use policy is part of these Terms.
8. Intellectual property
The Service, its software, design, brand, text and other material (excluding Your Content and Output) belong to us or our licensors and are protected by law. We give you a limited, personal, revocable, non-transferable license to use the Service as allowed by these Terms. You may not copy, modify, distribute or create derivative works from the Service except as the law expressly permits. If you send us ideas or feedback, we may use them without obligation to you.
9. Third-party services
The Service relies on third-party providers, including AI model providers, hosting, authentication, payments and analytics. Their availability, behavior and terms are outside our control. Payments are processed by Stripe under Stripe's terms; we never see your full card number. Links to other sites are provided for convenience and are not endorsements.
10. Ending the relationship
You can stop using the Service at any time and delete your account in Settings or by emailing us. We may suspend or end your access at any time for breach of these Terms, for legal or security reasons, or if we discontinue the Service or a feature. If we end a paid plan without cause, we will refund the unused part of the current billing period; otherwise, the Refund Policy applies. Sections that by their nature should survive (including 5, 6, 8, and 11 to 16) survive termination.
11. Disclaimers
The Service and all Output are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that Output is correct, that using the Service will improve grades or results, or that the Service meets any school's rules. Some jurisdictions do not allow some of these disclaimers; in that case they apply to the extent permitted.
12. Limitation of liability
To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost grades, lost opportunities, lost data, or the cost of substitute services, even if we were told they were possible; and (b) our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. These limits apply to all theories of liability. They do not limit liability that cannot be limited by law, including for our fraud, gross negligence or willful misconduct, and they do not remove statutory consumer rights where you live.
13. Indemnity
If you are an adult, you agree to defend and hold us harmless from claims and costs arising from Your Content, your breach of these Terms, or your violation of law or of another person's rights. Parents and guardians who accept these Terms on behalf of a minor accept this Section for the minor's use.
14. Dispute resolution and arbitration
Please read this Section carefully. It affects your rights.
Informal resolution first. Before starting any formal proceeding, you agree to email [support@heyhomework.com] with your name, a description of the problem and what you want, and to give us 30 days to try to resolve it.
Arbitration. If we cannot resolve it, any dispute, claim or controversy between you and us relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek an injunction in court to stop unauthorized use or abuse of intellectual property. The Federal Arbitration Act governs this Section. The arbitrator decides all issues except that a court decides questions about the scope and enforceability of the class-action waiver. Arbitration may be held by video or in the county where you live. We will pay the filing and arbitrator fees for claims under US$10,000 unless the arbitrator finds the claim frivolous.
Class-action waiver. You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not consolidate claims of different people. If this waiver is found unenforceable for a particular claim, that claim must be brought in court, and the rest of this Section still applies to other claims.
Opt-out. You can opt out of arbitration by emailing [support@heyhomework.com] with the subject "Arbitration opt-out", your name and account email, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Changes. If we change this Section, we will tell you and you will have 30 days to opt out of the change; the change will not apply to disputes already begun.
Where arbitration does not apply. If you live in the European Economic Area, the United Kingdom, or another place whose law does not allow mandatory consumer arbitration, this Section does not apply to you, and you keep the right to bring claims in the courts of your home country; EU residents may also use the European Commission's online dispute resolution platform.
15. Governing law
These Terms are governed by the laws of the State of [Arizona], United States, without regard to its conflict-of-law rules, and disputes not subject to arbitration will be brought in the state or federal courts located in [Maricopa County, Arizona]. If you are a consumer in a country whose law gives you mandatory protections, nothing in these Terms takes those protections away.
16. Changes to these Terms
We may update these Terms from time to time. We will post the new version with a new "last updated" date and, for material changes, tell you by email or a notice in the Service at least 14 days before they take effect, except where a change is needed for legal or security reasons. Using the Service after a change takes effect means you accept it. If you do not agree, stop using the Service and, if you have a paid plan, cancel it before the change takes effect.
17. Language versions
We provide translations of our legal documents for convenience only. If a translation and the English version differ, the English version controls, except where the law of the country where you live requires otherwise.
18. General
These Terms, together with the policies they reference, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them to a successor of the Service. Notices to you may be sent to your account email. Nothing in these Terms creates a partnership, agency or employment relationship.
